These Terms and Conditions govern the provision of gardening and related services by Gardeners Catford to residential and commercial clients. By placing a booking, accepting a quotation, or allowing work to commence, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.

Scope of Services

Gardeners Catford provides a range of gardening and outdoor maintenance services, which may include lawn care, hedge trimming, planting, garden tidy-ups, soft landscaping, and related garden maintenance tasks. The specific services to be provided will be described in our quotation or booking confirmation.

Any additional work not expressly stated in the quotation or booking confirmation will be treated as a variation and may incur additional charges. We reserve the right to decline work that falls outside our normal service offering or that we reasonably consider unsafe, unlawful, or unsuitable for our equipment and expertise.

Booking Process

Bookings for gardening services may be initiated by you through our website contact form or other communication channels where offered. A booking is only considered confirmed when we issue a written confirmation or a quotation that you accept in writing.

When requesting a booking, you must provide accurate information regarding the property, access arrangements, garden size, and the nature of the work required. Our quotation and scheduling may depend on the accuracy of this information. If on arrival we find that the information provided was incomplete or inaccurate, we may adjust the price, modify the scope of work, or in some cases refuse to carry out the service.

We may offer either one-off services or recurring maintenance visits. Any regular service arrangement will be confirmed with an agreed frequency, such as weekly, fortnightly, or monthly, and can be adjusted by mutual agreement subject to availability.

Quotations and Pricing

All quotations are provided in good faith based on the information you supply and, where applicable, a site visit. Unless otherwise stated, quotations are valid for 30 days from the date of issue. Prices may be given as a fixed price for a defined scope of work, or on an hourly or daily rate basis.

We reserve the right to revise a quotation if there are changes in the scope of work, unforeseen site conditions, significant changes in material costs, or regulatory requirements that affect the services. Any such changes will be communicated to you and will only be implemented with your agreement.

Access and Client Responsibilities

You are responsible for ensuring that we have safe and reasonable access to the property and all areas of the garden where work is to be carried out. This includes arranging access through gates, communal areas, or parking spaces where necessary.

You must inform us in advance of any hazards, restrictions, underground services, or special requirements that may affect the work, such as ponds, cables, irrigation systems, fragile surfaces, or protected plants. We are not liable for damage to items that were not reasonably identifiable or disclosed.

Pets and children must be kept away from working areas for safety reasons. You are responsible for complying with any leasehold, freehold, or landlord requirements relevant to the works and for obtaining any necessary permissions from neighbours, building management, or local authorities where applicable.

Materials, Equipment, and Standards

We will provide the tools, machinery, and standard materials necessary to perform the agreed services, unless otherwise stated in the quotation. Where specific plants, materials, or products are requested by you, we will use reasonable efforts to source them but cannot guarantee availability or exact matches for size, colour, or variety.

All services will be carried out with reasonable care and skill and in line with generally accepted gardening practices. However, as gardening work is subject to weather, soil conditions, and other natural factors, we do not guarantee particular results such as growth rates, flowering times, or the long-term survival of plants.

Weather and Site Conditions

Gardening work is naturally affected by weather and ground conditions. If, in our reasonable opinion, conditions on the day of the booking make it unsafe or impractical to carry out the work, we may suspend, postpone, or adjust the services. We will seek to reschedule at a mutually convenient time.

Where a visit must be rescheduled due to adverse weather, no cancellation fee will apply, but any costs already incurred in procuring non-returnable materials specifically for your job may still be payable.

Payments and Invoicing

Payment terms will be set out in your quotation or booking confirmation. For one-off or project-based work, a deposit may be required before commencement, with the balance payable upon completion or in staged payments for longer projects. For regular maintenance services, payment may be required after each visit or monthly in arrears, as agreed.

All fees are payable in the currency specified on the invoice. You are responsible for paying any bank or payment provider charges so that we receive the full invoiced amount. Unless otherwise stated, prices are inclusive of labour and standard equipment but may exclude materials, disposal fees, or specialist services.

Invoices are payable by the due date stated on the invoice. If no due date is specified, payment is due within 7 days of the invoice date. We reserve the right to charge interest or late payment fees in line with applicable law for overdue amounts and may suspend further services until outstanding sums are paid in full.

Cancellations and Rescheduling by the Client

If you need to cancel or reschedule a confirmed booking, you must notify us as early as possible. For standard visits, no cancellation fee will be charged if at least 24 hours notice is given before the scheduled start time. Cancellations made with less than 24 hours notice may incur a cancellation fee of up to 50 percent of the quoted service price, at our discretion.

For larger projects or work involving special-order materials, bespoke plants, or hired equipment, we may require a longer notice period for cancellations or rescheduling. Any non-refundable costs that we have already incurred on your behalf, such as purchased materials, may be charged to you if a project is cancelled.

If we arrive at the property and are unable to gain access or carry out the work due to reasons within your control, this may be treated as a late cancellation and a call-out or cancellation fee may apply.

Cancellations and Changes by Gardeners Catford

We aim to honour all confirmed bookings. However, we may need to cancel or reschedule services due to staff illness, equipment failure, adverse weather, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will notify you as soon as practicable and arrange an alternative date or time.

Where we are unable to provide the service at all, any deposits or advance payments you have made for the affected service will be refunded, subject to any materials already purchased specifically for your job and delivered to site with your agreement.

Client Satisfaction and Complaints

We aim to provide high-quality gardening services and value your feedback. If you are dissatisfied with any aspect of the work, you must notify us within 48 hours of completion of the visit or project, providing reasonable details and, where possible, photographs.

We will review your concern and, if we conclude that the service did not meet the agreed standard, we may, at our discretion, return to rectify the issue, offer a partial refund, or provide a credit for future services. Our liability in such cases will be limited as set out in the Liability and Limitations section.

Waste Handling and Green Waste Regulations

During gardening services, green waste and other debris may be generated. Our standard service includes neatly gathering garden waste into piles or your own garden waste containers, unless agreed otherwise. Removal and disposal of green waste or other waste may incur additional charges, which will be stated in the quotation where applicable.

We comply with relevant waste regulations when transporting and disposing of garden waste. Where we agree to remove waste from your property, it will only include waste generated by our work. We do not accept responsibility for disposing of pre-existing waste unless specifically agreed in writing.

Certain items, such as soil, rubble, large branches, or hazardous materials, may require specialist disposal and may not be covered by our standard waste removal service. Any such additional disposal requirements will be subject to separate charges and will only be undertaken by agreement.

Health, Safety, and Conduct

We take health and safety seriously and will use reasonable care to operate safely on your property. Our team members are instructed to follow safe working practices, including the use of appropriate personal protective equipment and equipment handling procedures.

You must not ask our workers to undertake tasks that fall outside the agreed scope of work or that they reasonably consider unsafe, such as using unsuitable ladders, working at excessive heights, or operating equipment in dangerous conditions.

We reserve the right to withdraw our staff from site if they encounter abusive behaviour, harassment, or unsafe conditions. In such cases, you may still be liable for part or all of the quoted service fee, depending on the circumstances.

Liability and Limitations

We will exercise reasonable care and skill in providing our services. However, to the fullest extent permitted by law, we are not liable for any indirect, consequential, or economic loss, including loss of profit, loss of enjoyment, or loss arising from delays or rescheduling.

Our liability for direct loss or damage to property arising from our negligence or breach of contract is limited to the total amount paid or payable by you for the specific service during which the incident occurred, unless a different level of liability is mandated by law.

We are not responsible for damage to underground pipes, cables, irrigation systems, or other concealed services that have not been clearly identified or marked out by you in advance. We are also not responsible for damage caused by pre-existing defects, structural weaknesses, pests, diseases, or extreme weather conditions.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

Insurance

Gardeners Catford maintains appropriate insurance cover in connection with the provision of our services, including public liability insurance at a level considered reasonable for the nature of our work. Evidence of insurance can be provided on request.

Intellectual Property

Any designs, planting schemes, layout plans, or written materials that we supply as part of our services remain our intellectual property unless expressly assigned in writing. You may use such materials solely for the purpose of implementing or maintaining your garden and may not reproduce or distribute them commercially without our consent.

Data Protection and Privacy

We collect and process personal information such as your name, address, and contact details for the purposes of managing bookings, providing services, invoicing, and fulfilling our legal obligations. We handle this information in accordance with applicable data protection laws.

Your personal data will not be sold to third parties. It may be shared with trusted partners only where necessary to provide the services, such as suppliers delivering materials to your address, and always in line with relevant legal requirements.

Amendments to Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, industry practices, or legal requirements. The version in force at the time you make a booking or accept a quotation will apply to that particular service, unless a different arrangement is agreed in writing.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising from or in connection with them or the provision of our services, are governed by and construed in accordance with the laws of England and Wales.

You and Gardeners Catford agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from the remaining terms, which will continue in full force and effect.

Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation issued by us, constitute the entire agreement between you and Gardeners Catford in relation to the services. They supersede any prior discussions, correspondence, or representations, whether written or oral, relating to the same subject matter.
